Welcome to Bonder ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our collaborative group travel planning application and related services (the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Eligibility

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Description of Service

Bonder is a collaborative group travel planning application that allows users to:

Create and organize travel itineraries and plans
Add destinations, notes, and expense tracking
Invite travel companions and collaborate on plans together
Vote on and discuss proposed activities
Track and split group expenses
Use mapping and visual content through integrated third-party services

We offer a free tier with complimentary trip unlocks, as well as paid options for additional trips.

4. User Accounts

Account Creation

To use certain features of our Service, you must create an account. You may create an account using:

Email and password
Google OAuth
Facebook OAuth

Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach

Account Termination

We may suspend or terminate your account if you:

Violate these Terms
Engage in illegal activities
Harass or abuse other users or our staff
Use the Service for malicious purposes
Remain inactive for an extended period
Fail to pay applicable fees

5. Subscription and Payment

Paid Options

We offer the following paid options:

Trip Pass — a one-time payment that permanently unlocks a single trip. Trip Passes are non-refundable and do not involve recurring billing.
Free tier — new accounts receive a limited number of complimentary trip unlocks at no charge.

Billing

Payment is processed through Stripe, our third-party payment processor
We accept major credit cards
All fees are non-refundable

Cancellation

Trip Passes are one-time purchases and are not subscriptions. There is no cancellation process for Trip Passes, and no recurring charges will be made.

6. User Content

Your Content

You retain ownership of all content you create, upload, or share through the Service, including:

Travel plans and itineraries
Destinations and notes
Expense information
Any other data you input

License to Us

By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, store, and display your content solely to provide and improve the Service.

Content Sharing

When you share your travel plans with others, you understand that shared content may be viewed and accessed by those recipients.

Prohibited Content and Uses

You agree not to use the Service to:

Engage in illegal activities or violate applicable laws
Harass, abuse, or harm others
Send spam or unsolicited communications
Upload malicious software or code
Impersonate others or misrepresent your identity
Violate others' intellectual property rights
Attempt to gain unauthorized access to our systems

7. Intellectual Property

Our Rights

The Service, including its design, functionality, and content (excluding user content), is owned by Bonder and protected by intellectual property laws.

Third-Party Services

Our Service integrates with third-party services including Google Maps, Unsplash, Google Gemini (itinerary analysis and suggestions), and Resend (email delivery), each of which has its own terms and intellectual property rights. When you use itinerary analysis or suggestion features, relevant trip content may be transmitted to Google's Gemini API for processing.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information.

9. Service Availability

No Uptime Guarantee

We strive to maintain service availability but do not guarantee uninterrupted access to the Service.

Service Modifications

We reserve the right to:

Modify, suspend, or discontinue the Service at any time
Add, remove, or modify features
Update these Terms as necessary

We will provide reasonable notice of significant changes when possible.

10. Disclaimers and Limitations

No Travel Guarantees

We do not guarantee the accuracy of travel information
We are not responsible for travel bookings, reservations, or actual travel arrangements
Travel decisions are made at your own risk and discretion

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BONDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Bonder from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party

12. Dispute Resolution

Governing Law

These Terms shall be governed by the laws of the State of Ohio and applicable federal law, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Ohio, and the decision shall be final and binding.

Exceptions to Arbitration

Either party may seek injunctive relief in court for intellectual property violations or breaches of confidentiality.

13. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Bonder regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
